Welcome to the blanjablanja.id App

PLEASE READ ALL OF THESE TERMS OF USE BEFORE ACCESSING OR USING THE APPLICATION BLANJABLANJA.ID. BY CONTINUING TO ACCESS OR USE THE APPLICATION BLANJABLANJA.ID AND/OR SERVICES, YOU AGREE TO ABIDE BY AND COMPLY WITH ALL RELEVANT STATUTORY PROVISIONS AND THESE TERMS OF USE, INCLUDING ALL CHANGES THERE TO THEM AND THE TERMS OF USE OF ANY SERVICE PROVIDER, THIRD PARTY CONTENT PROVIDER, OFFER PROVIDER OR PAYMENT METHOD PROVIDER. IMMEDIATELY DISCONTINUE ACCESS TO OR USE OF THE APPLICATION BLANJABLANJA.ID AND/OR SERVICES IF YOU DO NOT AGREE TO ANY PART OF THESE TERMS OF USE.

1. General Provisions

These Terms of Use are an agreement between the user ("you") and PT. Cipta Kreasi Mahaputra ("We"), a Limited Liability Company established and operating legally under the laws of the Republic of Indonesia and domiciled in the Province of Bali, Indonesia. These Terms of Use govern your access to and use of the application, website (www.blanjablanja.id), content, products and ordering, payment or use of the services provided by us (hereinafter, collectively, referred to as the "blanjablanja.id Application).

By agreeing to these Terms of Use, you also agree to additional Terms of Use, including the Terms of Use on each Service, and their changes which are an integral part of these Terms of Use (hereinafter, the Terms of Use, additional Terms of Use, and their changes are collectively referred to as the "Terms of Use").

2. Use of blanjablanja.id Applications and Services

Access to and use of the Application blanjablanja.id subject to the following Terms of Use:

2.1        You have complete freedom to select, use or not, or stop using the blanjablanja.id Application.

2.2       We only facilitate you to find the services you need by providing blanjablanja.id Application. All Services are provided directly by independent third parties who agree to be "Service Providers".

2.3         When ordering the Services, blanjablanja.id Application will connect you with service providers available in the vicinity of your location. This way, some services can't be used when you don't turn on the location assignment feature. Furthermore, if the Service Provider accepts your order, we will inform you of the status of your order through the blanjablanja.id Application.

3. Opening and Accessing blanjablanja.id Account

3.1         Before using the application blanjablanja.id.  you must agree to these Terms of Use and privacy policy, and register yourself by providing the information required by us. When registering, We will ask you to provide your full name, e-mail address and personal mobile phone number. You can change your personal data information in the settings feature in the blanjablanja App.

3.2         After registration, Our system will generate the verification code automatically and send the verification code via a short message to the mobile phone number you provide. You need to verify by entering the verification code on the registration page in blanjablanja.id App.

3.3         Upon verification, our system will create a personal blanjablanja.id account ("Account") for you that can be used to use the Application blanjablanja.id and order services through the blanjablanja.id Application. Your mobile phone number is attached to your Account so you cannot create a new Account with a registered mobile phone number. The same applies if you later change your mobile phone number in the settings menu in the blanjablanja.id App.

3.4         In the event that you have exited your Account, you will need to enter the e-mail address or mobile phone number you provided at the time of registering you and enter the verification code, which is then sent automatically by our system to your registered mobile phone number, on the access page.

VERIFICATION CODE (ONE TIME PASSWORD/OTP) IS GENERATED AUTOMATICALLY BY OUR SYSTEM. WE DON'T KNOW AND NEVER ASK FOR YOUR VERIFICATION CODE. NEVER SHARE YOUR VERIFICATION CODE WITH ANYONE EVEN TO US OR ANY OTHER PARTY CLAIMING TO BE OUR REPRESENTATIVE.4. Your Account

4.1         Your Account may only be used by you and may not be transferred to others for any reason. We reserve the right to refuse to facilitate an order if we know or have sufficient reason to suspect that you have transferred or allowed your Account to be used by someone else.

4.2         The security and confidentiality of your Account, including your registered name, registered e-mail address, registered mobile phone number, payment details and Payment Method you choose, and verification codes generated and sent by our system or Payment Method Provider are entirely your sole responsibility. All losses and risks incurred as a result of your negligence maintain security and confidentiality as stated are borne by yourself. In such event, we will consider any use or order made through your Account as a legitimate request from you..

4.3         Please notify us immediately if you become aware of or suspect that your Account has been used without your knowledge and consent. We will take actions that we deem necessary and we may take against such use without such consent.

4.4         If you are a Service Provider, you may not use your personal Account or someone else's Account to order services that you will receive yourself as a Service Provider.

5.  Personal Information

The collection, storage, processing, use and sharing of your personal information, such as your name, e-mail address, and mobile phone number that you provided when you opened your Account are subject to the Privacy Policy, which is an integral part of these Terms of Use.6. Content, Information and Promotions

6.1         We or other parties we work with may make available Third Party Content that you may find on Mahaputra.id Application. In the event that Third Party Content is provided by another party we work with ("Third Party Content Provider"), we are not responsible for any part of the content of the Third Party Content. Your access to or use of such Third Party Content constitutes your consent to be subject to these terms and conditions.

              provisions set forth by Us or Third Party Content Providers, including to our Privacy Policy or third party Content Providers.

6.2         Third Party Content is any information, data, or actual news, created, compiled, developed and/or maintained by third party Content Providers or obtained by Third Party Content Providers from other third parties, where the Third Party Content Provider is responsible for obtaining any permissions necessary to display such Third Party Content, including but not limited to text or writings, images, quotes or quotes, photographs, illustrations, animations, videos, sound or music recordings, titles and/or descriptions to be displayed on the blanjablanja.id Application, including any links linking to it.

6.4         All information, Offers contained in the blanjablanja.id Application are only intended to provide you with the best experience when using the Mahaputra.id App or Services. You may not misuse the Offerings you receive during your use of the Mahaputra.id App or Services.

6.5         You agree to use the Offer in accordance with the terms, conditions and intent of the Offer and will not misuse, duplicate, monetize, transfer, use for commercial purposes or improperly take advantage of such promotions in any form or manner.

6.6         You understand that the Offer is non-exchangeable for cash, has a limited validity period and is subject to the terms applicable to each Such Offer.

7. Fees and Payments

7.1         Software downloads and use of Mahaputra.id Applications are free of charge. 

7.2         The Services available on the Application blanjablanja.id charge what you can find on the Application blanjablanja.id before you order the Services. We may change or update fees from time to time based on certain factors, including location, time, type of Services and applicable laws and regulations. We may also charge a certain amount of price and/or fees as payment for the use of the application blanjablanja.id that may be collected by us, our affiliates, or service providers.

7.3         You may make payments for services you access or use with cash or through electronic payment methods on the blanjablanja.id Application, including electronic money, debit or credit cards or other payment methods ("Payment Methods") that are subject to change at any time at our sole discretion.

7.4         In order to make a payment through a Payment Method, you must be officially registered with the Payment Method Provider you choose and use your own payment credentials. In the event that you use the registered credentials of another party, you are solely responsible for all necessary permissions and all losses or disputes arising between you and such other party, whether due to your negligence or misconduct, we, the Service Provider, the Third Party Content Provider, the Offer Provider or the Payment Method Provider.

7.5         We reserve the right to refuse or delay to forward your payment request through the Payment Method for certain reasons, including but not limited to indications or we have sufficient grounds to suspect fraud, fraud, violation of the Terms of Use, violations of applicable Laws and Regulations including those relating to payment instruments using cards, electronic money, payment transaction processing, anti-money laundering, corruption and prevention of terrorism financing, or other unreasonable or suspicious acts, including not fulfilling your obligations to us.

7.6         Further terms of fees applicable to certain Services, Third Party Content, Offers and/or Payment Methods can be found in the additional Terms of Use of the Services you order and the terms and conditions of the Service Provider, Third Party Content Provider, Offer Provider and/or Payment Method Provider.

8. blanjablanja.id Application Software

We only provide the official blanjablanja.id App software on official digital markets, such as the Appstore, and for use only on mobile phones, tablets and computers. Downloading the Application blanjablanja.id from a place other than the official digital market and/or into devices other than mobile phones, tablets or computers is a violation of these Terms of Use and against our intellectual property rights.

9. Intellectual Property

9.1         The Application blanjablanja.id and Services, including but not limited to, names, logos, program codes, designs, trademarks, technologies, databases, processes and business models, are protected by copyright, trademark, patent and other intellectual property rights available under the laws of the Republic of Indonesia registered either on behalf of us or our affiliates. We (and our licensors) own all rights and interests in the Application blanjablanja,id and Services, including all intellectual property rights relating to all features contained therein and related intellectual property rights.

 

9.2         Subject to these Terms of Use, we grant you a limited license that is not exclusive, revusable, non-transferable (without sublicense rights) to

(i)      download, access and use the Mahaputra.id Application, as is, only on your mobile phone, tablet or personal computer and only for purposes relating to your use of the Services, and

(ii)     access or use the content, information and related materials available on the Application Mahaputra.id for personal use only and not commercial purposes. Other rights and privileges not expressly granted in these Terms of Use are the rights of us or our licensors.

9.3         Any duplication, distribution, creation of derivative works, sales or offers to sell, performance in part or in whole, and use of the Application blanjablanja.id and/or the Services, whether digitally or otherwise or on devices other than mobile phones or tablets, including but not limited to the use of additional applications such as modified applications, emulators and others, which deviate from these Terms of Use, or the purposes of use determined by us, constitute a violation of our intellectual property rights.

9.4         You may not:

9.4.1         Remove any copyright, trademark or other proprietary notices contained in the blanjablanja.id Application.

9.4.2         Copy, modify, adapt, translate, create derivative works from, distribute, license, sell, transfer, publicly display in part or in whole, reverse engineer, transmit, transfer, broadcast, decompile, or disassemble any part of or otherwise exploit the Application blanjablanja.id (including the software, features and Services there there).

9.4.3         License, sublicense, sell, resell, transfer, transfer, distribute or commercially exploit or make available to others the Application blanjablanja.id and/or software by creating internet links to the Application blanjablanja.id or "frames" or "mirrors" of any software on other servers or wireless or internet-based devices.

9.4.4         Launching automated programs or scripts, including, but not limited to, web spiders, web crawlers, web robots, web ants, web indexers, bots, viruses or worms, or any program that may make multiple server requests per second, create heavy loads or impede the operation and/or performance of blanjablanja.id Applications.

9.4.5         Using site search or retrieval applications, manual or other automated devices for scraping, indexing, surveying, data mining, or in any way reproducing or circumventing the navigational or presentation structure of the application blanjablanja.id or its contents

9.4.6         Publish, distribute or reproduce in any way any copyrighted material, trademarks or other information we have without our prior written consent or the rights owner who licenses the rights to us.

9.4.7         Using and/or unauthorizedly accessing the blanjablanja.id Application for

(a)          damage, weaken or harm any aspect of the Application blanjablanja.id, the Services or related systems and networks, and/or

(b)          create similar competing products or services using ideas, features, functions or graphics resembling blanjablanja.id Application.

10. Your Responsibilities

10.1     You are solely responsible for the decisions you make to use or access the Application blanjablanja.id, Services, Third Party Content, Offers or Payment Methods. You must treat Service Providers, Third Party Content Providers, Offer Providers and Payment Method Providers with respect and must not engage in unauthorized, threatening or harassing conduct or actions when using the Services, Third Party Content, Offers or Payment Methods.

10.2     You are solely responsible for any losses and/or claims arising from your use of the application blanjablanja,id, Services, Third Party Content, Offers or Payment Methods through your Account, whether by you or any other party using your Account, in a manner contrary to these Terms of Use, The Privacy Policy, including the terms and conditions and privacy policy specified by the Service Provider, Third Party Content Provider, Offer Provider and Payment Method Provider, or applicable Laws and Regulations, including but not limited to anti-money laundering, counter-terrorism financing, criminal activity, fraud of any kind (including but not limited to phishing and/or social engineering activities), intellectual property infringement, and/or other activities that harm the public and/or any other party or that may or may be considered to damage our reputation.

11. Limitation of Our Liability

11.1        We provide the Application blanjablanja.id as is and we do not represent or warrant that the reliability, timeliness, quality, suitability, availability, accuracy, completeness or security of the Application blanjablanja.id may meet your requirements and will be in accordance with your expectations, including but not limited to the Services, Third Party Content, Offers and Payment Methods which are solely the responsibility of the Service Provider, Third Party Content Provider, Offer Provider and Payment Method Provider. We are not responsible for any loss or damage caused by any failure or error made by the Service Provider, Third Party Content Provider, Offer Provider or Payment Method Provider or Your failure or error in complying with Our Terms of Use, Service Providers, Third Party Content Providers, Offer Providers or Payment Method Providers.

11.2       blanjablanja.id Application may experience limitations, delays, and other problems contained in the use of the internet and electronic communications, including your device, Service Provider, Third Party Content Provider, Offer Provider or Payment Method Provider is damaged, not connected to the internet, out of range, turned off or malfunctioning. We are not responsible for any delays, delivery failures, damages or losses resulting from such problems.

11.3       We are under no obligation to supervise Your access to or use of the blanjablanja.id Application. However, we continue to conduct supervision for the purpose of ensuring the smooth use of the blanjablanja.id Application and to ensure compliance with these Terms of Use, applicable Laws and Regulations, court rulings, and/or provisions of Administrative institutions or other governmental bodies.

11.4       We have no liability whatsoever, including to take any further action or legal action deemed necessary by You, the Service Provider, third party Content Provider, Offer Provider or Payment Method Provider, against any problems or disputes arising between You and the Service Provider, Third Party Content Provider, Offer Provider or Payment Method Provider. However, we will facilitate any issues or disputes arising between you and the Service Provider, Third Party Content Provider, Offer Provider or Payment Method Provider with the necessary reasonable efforts. When we facilitate the resolution of problems or disputes between you and the Service Provider, Third Party Content Provider, Offer Provider or Payment Method Provider, we do not act as a mediator and do not incur any further liability to us.

12. Troubleshooting

12.1     If you experience a system outage, know or suspect that your Account has been hacked, used or misused by another party, or if your personal mobile phone or tablet device is lost, stolen, hacked or virused, please report it to us immediately so that we can take immediate action necessary to avoid any use, misuse or loss arising out of or may arise further.

12.2     If you experience any problems or problems relating to the Services, Third Party Content, Offers or payments via Payment Methods, or the treatment of Service Providers, Third Party Content Providers, Offer Providers or Payment Method Providers you may raise your complaint through the features we provide, including ratings and comments, or by contacting us.

12.3     In order to submit complaints, questions, disclaimers and others ("Reports"), you need to provide sufficient information, including but not limited to, a summary of the facts occurring, evidence you have, order numbers, and personal information, such as email addresses and registered mobile phone numbers.

12.4     In response to any Reports you submit, we will verify in advance by matching the information you provide and your personal information contained in our systems. If necessary, we may directly ask you to provide the information necessary for verification purposes.

12.5     We may refuse to follow up on Your Report if the information you provide does not match the personal information contained in our system or if the report is submitted in connection with, against, on behalf of or by another party different from the relevant Account owner who is officially registered on our system. We may discontinue follow-up to your report if we, in our sole discretion, consider that your Report is not supported by sufficient and clear facts, or has been completed. We may also forward your report to the Service Provider, Third Party Content Provider, Offer Provider or Payment Method Provider to be resolved directly by you and the Service Provider, Third Party Content Provider, Offer Provider or Payment Method Provider.

12.6     Against certain Reports relating to the Services, we may, at our sole discretion, facilitate meetings between you and the Service Provider for the purpose of peaceful and familial resolution of problems. In such case, if you feel the need to take any other action, including any legal action, you may do so on your sole personal responsibility.

12.7     Against certain Reports regarding Payment Methods, we may refund you through the means specified by us or in conjunction with the Payment Method Provider, at our sole discretion. We will not refund any other party that is different from the credentials registered with the blanjablanja.id Account or Payment Method Provider, including if you used the other party's credentials to make payments through the Payment Method.

13. Temporary Suspension and Permanent Suspension of blanjablanja.id Account

13.1     You may remove the blanjablanja.id Application from your mobile phone and/or tablet at any time. We have no liability whatsoever to you for matters arising from the removal of the blanjablanja.id Application, temporary suspension or permanent suspension of Your Account. However, you remain responsible for resolving your existing obligations, including but not limited to, any liability that may arise as a result of any existing dispute, claim or other legal action, prior to the date of removal of the blanjablanja.id Application, temporary suspension or permanent suspension of your Account.

13.2     Your account may be temporarily suspended or permanently suspended due to the following, including but not limited to, the following:

13.2.1         Your report that your Account was used or allegedly used or misused by others.

13.2.2         Your report that your mobile phone, tablet, laptop, personal computer is lost, stolen or hacked.

13.2.3         We know or have sufficient reason to suspect that Your Account has been transferred or used by others.

13.2.4         We know or reasonably suspect that things have happened that in our view have been or may harm us, you, the Service Provider or any other party.

13.2.5         Our system detects any improper use of your Account or any liability under the Terms of Use, and/or Privacy Policy not met by you.

13.2.6         You have passed away, been placed under guardianship or custody or suffered any other disability that renders you incapable of law under the prevailing Laws and Regulations.

13.2.7         Your or any other party's use of the Application blanjablanja.id or Services (which uses your Account) in a manner contrary to these Terms of Use, Privacy Policy or applicable Laws and Regulations.

13.2.8         An order for account freeze, whether temporary or permanent, issued by the relevant government or monetary institution or based on a court order issued in accordance with the applicable Laws and Regulations.

13.2.9         If your Account is frozen and you have clear evidence that your Account should not be frozen, you may make a report to us to submit such evidence. Upon further examination of your report, we will, at our sole discretion, determine whether to terminate or continue the suspension of your Account. The freeze will not proceed unreasonably if we determine that the matters resulting in the suspension have been resolved.

14. Actions We Deem Necessary

14.1        If we know or have sufficient reason to suspect that you have committed an act of immorality, violations, crimes or other acts contrary to these Terms of Use and/or applicable Laws and Regulations, whether referred to in these Terms of Use or not, we reserve the right to and may suspend the Account, whether temporary or permanent, or terminate your access to the blanjablanja.id Application, including the Services, Third Party Content, Offers and/or Payment Methods contained therein, conduct checks, claim damages, report to the authorities and/or take any other action we deem necessary, including criminal or civil legal action.

14.2       We will follow up by conducting an investigation and/or facilitating the relevant Service Provider to report to the authorities if we receive a report of a violation of these Terms of Use or a violation of the prevailing Laws and Regulations, in connection with:

14.2.1         Verbal harassment or violence, including but not limited to, over your physical, gender, ethnicity, religion and race, which you commit against the Service Provider.

14.2.2         Physical harassment or violence you commit against the Service Provider.

14.2.3         Sexual harassment or violence, both verbally and physically, that you commit against the Service Provider.

14.2.4         These Terms also apply otherwise if you experience the above-mentioned actions taken by the Service Provider against You.

15. Your Statement

15.1       You represent and warrant that you are at least 20 (twenty) years of age or married and not under guardianship or custody and that you are legally in capacity and entitled to bind yourself to these Terms of Use. If you do not meet these conditions but continue to access or use the Application blanjablanja.id, Services, Third Party Content, Offers or Payment Methods, you represent and warrant that your actions to open, access or other activities within the Application blanjablanja.id have been approved by your parent, guardian or guardian. You expressly waive any statutory right to cancel or revoke any and all consents you give under these Terms of Use at a time when you are considered legally mature.

15.2       You agree to access or use the Application blanjablanja.id, Services, Third Party Content, Offers or Payment Methods only for the purposes specified in these Terms of Use and not to misuse or use the Application blanjablanja.id, Services, Third Party Content, Offers or Payment Methods for fraudulent purposes, causing inconvenience to others, making false bookings or other actions that may or may be deemed to cause harm of any kind to others.

15.3       You understand and agree that all risks arising from your use of the Application blanjablanja.id, Services, Third Party Content, Offers and Payment Methods are solely your responsibility and you hereby agree to release us from any claims whatsoever in connection with any damage, interruption or other form of system disruption caused by unauthorized access by another party.

15.4       You expressly release us, including but not limited to, our officers, directors, commissioners, employees and agents, from any and all liabilities, consequences, material or immaterial losses, demands, costs (including advocate fees) or other legal liability arising out of or may arise as a result of your breach of these Terms of Use or in connection with the actions of the Service Provider, Third Party Content Provider , Offer Provider or Payment Method Provider.

15.5       Excluded from the foregoing, in the event of any direct loss resulting from our breach of these Terms of Use, you agree and expressly limit the amount of your claim to the full amount claimed or paid in connection with the event.

16. Force Majeure

Applications blanjablanja.id may be interrupted by events beyond our authority or control ("Force Majeure"), including but not limited to natural disasters, power outages, telecommunications disruptions, government policies, etc. You agree to release us from any claims and responsibilities, if We are unable to facilitate the Services, including fulfilling the instructions you provide through the blanjablanja.id Application, in part or in whole, due to a Force Majeure.

17. Other – Other

17.1     You understand and agree that these Terms of Use constitute an electronic agreement and your actions at the time of opening an Account or the 'login' button when accessing your Account constitute your active consent to bind yourself to the agreement with us so that the app's enforceability and Privacy Policy are lawful and legally binding and continue to apply throughout your use of the blanjablanja.id Application and Services.

17.2     You will not make any claim or objection to the validity of these Terms of Use or the Privacy Policy made in electronic form.

17.3     You may not assign your rights under these Terms of Use without our prior written consent. However, we may transfer our rights under these Terms of Use at any time to another party without the need for prior consent from or giving prior notice to you.

17.4     If You do not comply with or violate the provisions of these Terms of Use, and we do not take action directly, it does not mean that We waive Our right to take the necessary actions in the future.

17.5     These Terms remain in effect even after a temporary freeze, permanent suspension, removal of the Application blanjablanja or after the expiration of this agreement between you and us.

17.6     If any of the provisions of these Terms of Use are unenforceable, they will not affect the other.

17.7     We make these Terms of Use in Indonesian and English. Any differences will be interpreted in accordance with the Indonesian language.

17.8     These Terms of Use are governed by the laws of the Republic of Indonesia. Any and all disputes arising from the use of the blanjablanja.id Application or the Services are subject to the exclusive jurisdiction of the Denpasar District Court.
